1 Who These Terms Cover

These Terms apply to:

If you are using the App on behalf of a business or another person, you represent you have authority to bind them, and "you" includes that entity.

3.1 Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract.

3.2 Account Creation; Invitations

Account creation may be invitation-based. You agree to provide accurate information and keep it current.

3.3 Account Security

You are responsible for all activity under your account. Notify us immediately of unauthorized access or suspected security issues.

3.4 Separate Portals

The Platform may provide separate interfaces and permissions for Customers and Business Users. Access is subject to role-based controls.

4 What the Platform Does (and Doesn't Do)

We may change, suspend, or discontinue any part of the Platform at any time. We do not guarantee uninterrupted operation, error-free performance, or that all features will always be available.

5 Service Requests, Appointments, and Customer Approvals

5.1 Submitting Requests

When you submit a Service Request, you agree that:

5.2 Appointment Proposals, Approval, and Rescheduling

Appointments may be proposed through the App and may require your approval. If you reject or request a reschedule, timing and availability may change.

5.3 Estimates; Approval to Proceed

If an Estimate is presented in the App, you may be required to approve it before Work begins. Approval may authorize us (or the service provider) to perform the described Work and bill accordingly.

5.4 Changes and Additional Work ("Change Orders")

If conditions require changes (e.g., concealed damage), we may provide a revised Estimate or change order through the App or other written means. Additional Work may require additional approval.

5.5 Cancellations and No-Shows

You may cancel or reschedule subject to any cancellation terms disclosed in the App, in a Service Request, or in an Estimate/Invoice. We may charge fees for late cancellations or no-shows where permitted by law and disclosed in advance.

6 Payments, Billing, and Subscriptions

6.1 Invoices and Payment Timing

Invoices are payable according to the terms shown on the Invoice or as otherwise stated in the App. You are responsible for applicable taxes unless prohibited by law.

6.2 Payment Processing

Payments may be processed by third-party payment processors. You authorize us and our processors to charge your payment method for approved amounts. We typically do not store full payment card details (processors may).

6.3 Disputes

If you believe an Invoice is incorrect, you must notify us within 30 days of receipt and provide supporting details. We may suspend collection on the disputed portion while investigating.

6.4 Late Payments

Late payments may incur interest or fees to the extent permitted by law and disclosed on the Invoice or in the App.

6.5 Maintenance Plans / Memberships (If Offered)

If the App offers subscription tiers, maintenance plans, or memberships:

7 Communications and SMS/Text Messaging

7.1 Electronic Communications

By using the App, you consent to receive communications electronically (e.g., email, in-app notifications) about your account, Service Requests, Appointments, Estimates, Invoices, and payments.

7.2 SMS/Text Messages (Opt-In)

If you opt in to SMS, you consent to receive texts such as appointment reminders, status updates, and billing notifications. Message and data rates may apply. Message frequency varies.

7.3 Opt-Out

You can opt out of SMS at any time by:

Opting out of marketing texts will not necessarily stop purely transactional messages where legally permitted, but we will honor opt-out requirements as required by law.

8 User Content and Conduct

8.1 Your Content

You retain ownership of Content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), and display your Content solely to operate and improve the Platform and to provide services (e.g., sharing photos with technicians assigned to your request).

9 AI-Assisted Features (If Enabled)

The Platform may include AI-assisted features (for example: turning natural-language descriptions into structured requests, generating recommendations, or suggesting actions).

10 Third-Party Services and Links

The Platform may integrate third-party services (e.g., payment processors, mapping, email/SMS providers). Your use of those services may be governed by their separate terms and privacy policies. We are not responsible for third-party services.

11 Intellectual Property

The Platform, including its software, design, logos, and content (excluding your Content), is owned by or licensed to the Company and is protected by intellectual property laws. You receive a limited, revocable, non-transferable license to use the Platform for its intended purpose, subject to these Terms.

12 Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Platform, you agree to the Privacy Policy.

We do not guarantee that:

Some jurisdictions do not allow certain limitations; in that case, these limitations apply to the fullest extent permitted.

You agree to indemnify and hold harmless the Company and its officers, directors, employees, contractors, and agents from any claims, damages, liabilities, and expenses (including attorneys' fees) arising from:

We may suspend or terminate your access to the Platform if we reasonably believe you violated these Terms, created risk for others, or used the Platform unlawfully.

You may stop using the Platform at any time. Some obligations (e.g., payment obligations, indemnification, limitation of liability) survive termination.

17 Dispute Resolution; Governing Law

17.1 Governing Law

These Terms are governed by the laws of the State of Texas, excluding conflict-of-laws rules.

17.2 Venue

Unless arbitration is required below, disputes will be brought in the courts located in Harris County, Texas, and you consent to jurisdiction and venue there.

17.3 Arbitration (Optional)

For certain disputes, we may elect to resolve claims through binding arbitration rather than in court. Details of any arbitration provision will be provided separately if applicable.

18 Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the App, by email, or as otherwise required by law. Continued use of the Platform after the effective date of updated Terms constitutes acceptance.
